Supreme Court Extends Block On Using Alien Enemies Act For Deportations

The Supreme Court has extended the freeze on the Trump administration’s use of the Alien Enemies Act for deportations. In a 7-2 vote the court ruled that Trump violated the due process rights of Venezuelan migrants in its expedited removal efforts using the 18th century wartime law. The block is temporary but Venezuelan immigrants can’t be deported until lower court cases are resolved.

The Trump administration in March defied a federal judge’s order barring the deportation of about 250 people the government claims are Tren de Aragua gang members.

The government argued the deportation flights, which were not turned around as ordered, had taken off before the judge’s written order came through and were justified under the Alien Enemies Act.

Following lower court rulings, the Supreme Court last month allowed the administration to resume use of the Alien Enemies Act to deport alleged Venezuelan gang members to El Salvador.

But the court said the government has to give deportees “reasonable time” to challenge their removal in court before leaving the country.
