It appears the Trump administration is trying to save face by charging Abrego Garcia with illegally transporting undocumented migrants in 2022, even though at the time he was deported, Abrego García was not under investigation and hadn’t been charged with any crime.

The investigation into a 2022 incident was launched in April, after Abrego Garcia had been deported.

From CNN:

For months, the Trump administration has been locked in an intense standoff with the federal judiciary over court orders for the government to “facilitate” Abrego Garcia’s return from El Salvador, where he was mistakenly deported in mid-March, in a situation that one federal judge warned could present an “incipient crisis” between the two branches.

Abrego Garcia has been indicted on two criminal counts in the in the Middle District of Tennessee: conspiracy to unlawfully transport illegal aliens for financial gain and unlawful transportation of illegal aliens for financial gain.

The indictment unsealed Friday afternoon accuses Abrego Garcia and others of partaking in a conspiracy in recent years in which they “knowingly and unlawfully transported thousands of undocumented aliens who had no authorization to be present in the United States, and many of whom were MS-13 members and associates.”

The 2022 incident in Tennessee initially ended with a warning from local authorities to renew his expired license.

More from ABC News:

The criminal investigation that led to the charges was launched in April as federal authorities began scrutinizing the circumstances of a 2022 traffic stop of Abrego Garcia by the Tennessee Highway Patrol, according to the sources.

Abrego Garcia was pulled over for speeding in a vehicle with eight passengers and told police they had been working construction in Missouri.

According to body camera footage of the 2022 traffic stop, the Tennessee troopers — after questioning Abrego Garcia — discussed among themselves their suspicions that Abrego Garcia might be transporting people for money because nine people were traveling without luggage, but Abrego Garcia was not ticketed or charged.
