Appeals Court: CA Bakery Discriminated Against Same-Sex Wedding

An appeals court in California ruled a Kern County baker violated the rights of a gay couple when she refused on religious grounds to sell a cake for their wedding. The couple asked to purchase a pre-designed, generic 3-tier cake without any “gay” references or adornment. But the bakery refused to sell to them. #FAFO From • The Advocate:

The case started in August of 2017 when Eileen and Mireya Rodriguez-Del Rio visited Tastries Bakery in Bakersfield to purchase a cake for the upcoming wedding.

According to court documents, the couple were helped by staff and chose a pre-designed cake with “three tiers with white buttercream frosting without any writing, symbols, engravings, images or toppers.”

Staff told the couple it was a popular choice for “birthdays, baby showers, weddings, and quinceaneras,” but then refused to sell the cake when they learned it was for their same-sex wedding.

Past court cases with bakeries refusing to sell wedding cakes to same-sex couples have hinged on the idea that the baker was being asked to custom design and execute their expertise/artistry for an even that offended their closely-held religious beliefs. The cake in question here was a blank white cake. The bakery reportedly canceled a cake tasting with the couple and three friends when they realized the cake was for a same-sex wedding.
