Special Counsel Jack Smith has filed a motion to dismiss the January 6th prosecution against Donald Trump. This comes as no surprise since the Department of Justice has a long-standing policy that a sitting president can’t be prosecuted.

Smith has moved to dismiss the case without prejudice, meaning it could be refiled at some point in the future, but the statute of limitations will expire and the case will likely not be refiled against Donald Trump.
It is expected that Special Counsel Smith will move to remove Donald Trump from the Mar a Lago documents case this afternoon as well.
