Upstate NY Judge Removed After Refusing To Marry Same-Sex Couple

Onandaga County District Attorney Bill Fitzpatrick has announced Judge Felicia Pitts Davis is being removed from her role in a Syracuse court for her alleged refusal to marry two women last month. From CNY Central:

On Nov. 16, Pitts Davis performed the wedding for a heterosexual couple before walking out of the room when it was time for two women to be wed.

The couple, Shawntay and Nicorra Davis, said that it was an odd situation, one that made them feel small. Another judge had to come into the courtroom to ensure they went home as a happily married couple.

Fitzpatrick said Pitts Davis’ actions fit the definition for “bigotry” following a Grand Jury meeting with Shawntay and Nicorra.

He is concerned about Pitts Davis overseeing cases that may involve a member of the LGBTQ community; a concern that appears to extend to others in the court system.

As I mentioned in my initial report last week, it appeared that court officials tried to hide the incident  refusing press questions asking to confirm that any marriages at all had been officiated that day. The decision to remove Pitts Davis was made by a Syracuse city administrative judge. The matter now head to the State Commission on Judicial Conduct where further action may be taken. According to Syracuse.com, this appears to be the first time a complaint has been filed regarding a judge refusing to marry a same-sex couple. New York Gov. Kathy Hochul has weighed in on the issue as well as the mayor of Syracuse and Central New York Pride.
