Kansas Demands Trans People Surrender Driver’s Licenses

Transgender people across Kansas are receiving letters informing them their driver’s licenses will now be considered invalid and must be surrendered at the DMV if the gender marker on their license does not reflect their gender assigned at birth.

Driving without a valid license could lead to class B misdemeanor charges which could result in up to six months in jail and a $1,000 fine.

This comes as a new anti-trans law passed by state lawmakers (SB244), vetoed by the governor but overridden by the GOP-legislature, comes into effect today.

The letter, which has been reported to Erin In The Morning by a Kansas-based activist, states that under House Substitute for Senate Bill 244, Kansas-issued driver’s licenses and identification cards must now reflect the credential holder’s “sex at birth.”

It warns that upon the law’s publication in the Kansas Register on Thursday, February 26, current credentials for affected individuals “will no longer be valid.”

The Legislature, the letter notes, “did not include a grace period for updating credentials,” and anyone operating a vehicle without a valid credential “may be subject to additional penalties.”

The new law also bans trans people from using bathrooms matching their gender identity in public buildings and creates a “bathroom bounty hunter” system that allows citizens to sue trans people they encounter in restrooms for at least $1,000 in damages.
