One order would declare that the federal government would recognize only two immutable sexes: male and female. The definition will be based on whether people are born with eggs or sperm, rather than on their chromosomes.
Under the order, federal prisons and shelters for migrants and rape victims would be segregated by sex as defined by the order.
In other words, trans women currently serving time in women’s prisons could be moved to male prisons in the near future. The State Department and the Department of Homeland Security will be directed to “ensure that official government documents, including passports and visas, reflect sex accurately.” One legal expert told NBC News that trans Americans — especially those who have X as their gender marker on passports – could have challenges re-entering the United States and could even be held in detention by border agents. I am not a man. Evan Urquhart is not a woman. No matter what Trump’s government said.
