Federal Court Blocks Trump From Imposing Tariffs Under Emergency Powers Law

Update: Reuters reports a federal appeals court on Thursday reinstated most of Donald Trump’s tariffs, a day after a trade court ruled Trump had exceeded his authority in imposing the duties and had ordered an immediate block on them.

A three-judge panel at the New York-based U.S. Court of International Trade unanimously blocked Donald Trump from imposing sweeping tariffs on imports under an emergency-powers law.

The Trump administration’s threat to impose certain steep tariffs on critical U.S. trading partners hung in limbo on Thursday after a panel of judges blocked a set of across-the-board charges. But both experts and trading partners around the world greeted the news with caution, not celebration.

The cases centered on the president’s use of a 1977 federal economic emergency law to issue many of his steep duties, including some of his tariffs on Canada, Mexico and China, and his “reciprocal” rates on much of the rest of the world, which Mr. Trump announced and then suspended in April.

The law does not specify tariffs as a tool available to the president to protect the United States from economic threats. But Mr. Trump has invoked its powers anyway, citing a need to take drastic action in response to a wide variety of urgent matters

In two separate lawsuits, a group of businesses and a coalition of state officials argued that Mr. Trump’s strategy had overstepped the authorities of his office, resulting in a global trade war that had saddled them with steep financial losses.

The Court of International Trade agreed, finding in a single ruling that the law “does not authorize” the president to use the emergency powers law to issue tariffs.

The 3-0 ruling was issued by Judges Timothy Reif (Trump appointee), Jane Restani (Reagan appointee) and Gary Katzmann (Obama appointee). So, it’ll be hard for Team Trump to argue this was some partisan panel.
