Tennessee: Governor Signs First State Law Allowing Therapists To Turn Away LGBTs

Tennessee Governor Bill Haslam today signed the first ever state law, hiding under the pretense of “religious freedom,” to allow therapists and counselors to refuse to treat clients based on “sincerely held religious principles.”

Read that – “turn away the gays.”

According to Buzzfeed‘s Dominic Holden, “House Bill 1840 provides counselors and therapists immunity from liability if they turn away a client whose goals, outcomes, or behaviors conflict with their beliefs. Counselors who decline clients would need to refer them to a provider who will see them.”

Republican Gov. Bill Haslam told The Associated Press on Wednesday that he signed the bill after talking to numerous counselors, including those who were in favor and those opposed.

The American Counseling Association called the legislation an “unprecedented attack” on the counseling profession and said Tennessee was the only state to ever pass such a law.

The bill’s sponsor, Senator Jack Johnson, maintains the bill is “not anti-anybody, it’s not anti-anything; it’s just pro-religious liberty.”

Via press release, Art Terrazas, the Director of Government Relations at the American Counseling Association said, “We are extremely disappointed that Governor Haslam has ignored the lessons learned in North Carolina, Georgia, and Mississippi and has elected to sign this dangerous bill into law. Plain and simple, this bill codifies discrimination.

“It not only disproportionately affects LGBTQ Tennesseans seeking counseling, but will also have unintended consequences that will reach Tennesseans in all walks of life—whether it’s a veteran suffering from PTSD, a woman suffering from spousal abuse, or a business owner simply trying to attract out of state clients.”

Sarcastic Tennessee Tourism Ad Skewers State For Anti-LGBT Legislation

Funny Or Die skewers the state of Tennessee for the recently passed anti-LGBT law that allows health care providers to deny services to LGBT patients based on discriminatory religious beliefs.

Tennessee: Same-Sex Marriage Plaintiffs Awarded $2 Million In Legal Fees

The state of Tennessee has been ordered by a federal judge in Nashville to pay the legal fees of the three couples whose lawsuit brought about marriage equality in the state.

From the Knoxville News Sentinel:

Judge Aleta Trauger awarded $1.98 million in attorneys’ fees and $59,916 in expenses to the plaintiffs, which include Knoxville veterinarians Valeria Tanco and Sophy Jesty. The award, allowed under federal law, is 15 percent less than the $2.33 million the plaintiffs sought.

“The results obtained in this case were superb and far-reaching,” Trauger wrote in her memo. “As the prevailing party, the plaintiffs will, therefore, be rewarded a significant portion of their requested reasonable attorney’s fees and expenses under Section 1988.”

A spokesman for Tennessee Attorney General Hebert H. Slatery’s office said his office was still reviewing the order Monday afternoon and did not have a comment. In court documents filed in January and unsealed on March 7, Slatery’s office argued the plaintiffs’ attorneys were overcharging for their services, and insisted they should be paid $1.1 million instead.

According to JoeMyGod, same-sex marriage plaintiffs nationwide have been awarded a total of $17,090,388.61 in legal fees and court costs, thus far.

I hope the haters who pushed the issue so far feel every single dime was worth losing.

Legislation Targeting Trans Students Defeated In Tennessee House

Good news out of Tennessee where anti-transgender legislation HB2414, the so-called “Gender Inspection” bill, was sent to legislative purgatory

At a hearing this morning in the House Education Administration & Planning Committee, members of the committee voted unanimously to send HB 2414 to “summer study”—meaning it will not become law during this legislative session. The vote to not advance the bill came after numerous members of the committee had met face-to-face with transgender students from across the state, hearing their personal stories of why this legislation would put them at real risk.

If passed, this invasive “Gender Check Bill” would have required that students prove that their anatomy matches that of their birth certificate as a condition of using the restroom. As with similar measures seen around the country, HB 2414 did not describe how school officials are to determine if a student’s gender matches the sex on their original birth certificate. This means under this bill, schools could be required to collect DNA or perform physical examinations before a student is allowed to use the restroom.

HB 2414 would have meant real economic consequences for Tennessee, too. Just last week, Republican Governor Bill Haslam voiced concerns that the “Gender Check” bill could jeopardize hundreds of thousands of dollars in federal education funding and force school districts to undergo costly litigation on their own dime.

Today’s bipartisan victory in Tennessee marks the latest in a wave of defeats of anti-transgender legislation across the country, including Virginia, Wisconsin and most notably South Dakota, where Republican Governor Dennis Daugaard vetoed a nearly identical bill after hearing from businesses, faith leaders and transgender students who would have been personally impacted.

Anti-transgender bills have popped up across the nation as trans people are becoming the new target for anti-LGBT forces.

Last week, South Dakota Gov. Dennis Daugaard vetoed similar legislation after meeting with transgender students who would have felt the full force of the bill.

Tennessee Official Bashes High School Student: “Let The Little Homo Sue”

I reported earlier this week about Lance Sanderson, an 18-year-old student at Christian Brothers High School in Memphis, wanted to bring a same-sex date to the school’s homecoming dance.

After school officials denied his request, Sanderson shared his story on social media and launched a petition in hopes of changing their minds. It didn’t.

Ultimately, Sanderson did not attend the homecoming dance at all. But, referencing his social media outreach on the issue, the school suspended Sanderson because they were upset about the unwanted media.

Now, Clark Plunk, a Lakeland commissioner, has publicly attacked the 18 year old in a Facebook rant which includes deriding the LGBT community as a whole. Here’s the text of the post via Towleroad:

It’s a Christian school so i you don’t like the rules don’t go there. As usual you have one person trying to change the rules just for himself. I’m told by the alumni the gay kid is looking for publicity. I hate the term gay. It makes them sound like they are happy and ‘Gay’ And they want to call people that criticize them homophobes to make them sound mean. As a whole, gays are mean, cruel spiteful people with an axe to grind.

The kids love the school a hate their school is in the limelight over a gay kid and his gay boyfriend….This is not about a homo and his rights it’s about a school that is loved by thousands and their memories and their right to keep their history and Christian values intact.

I would say let the little homo sue all he wants. The alumni of CBHS will meet him dollar for dollar and lawyer for lawyer. This is a threat to our values, our Christian values. Everyone shudders when the homosexuals say the word sue. They are vicious spiteful people.

Sanderson responded gracefully on his Facebook page:

I have been shown a few intolerant comments that were made against myself and other LGBT people. I have nothing but forgiveness for the people who wrote or agree with these comments. I recognize that we all have different beliefs and were taught from varying viewpoints. I hope that individuals and the community as a whole will use this as an opportunity to learn about other people’s beliefs. I know that through education and acceptance, we will move forward as a stronger community.

Tennessee TV Station Refuses To Air Marriage Equality Ad

A Tennessee television station, which previously had no policy on ads regarding same-sex marriage suddenly developed one this week when approached by LGBT advocacy group Freedom To Marry.

The ad featured a gay Republican physician – Dr. Jesse Ehrenfeld – who has just returned from deployment in Afghanistan and wants to marry his partner.

From Buzzfeed:

“I’m a Republican, I’m a doctor, and I’m a soldier,” says a voice over by Ehrenfeld as the commercial shows images of him serving in uniform, and back at home with his boyfriend, Judd Taback. “As a military physician, I take care of other people’s loved ones who are wounded in combat. But here at home, I’m fighting a different fight. Because I’m gay, I’m not allowed to marry my partner here in Tennessee where we live.”

The television station refused to air the spot.

“It’s just a very controversial and personal issue, and we just choose to not air a commercial on either side of that debate,” Tom Tolar, the president and general manager of Chatanooga-based WRCB, told BuzzFeed News in a phone interview.

The ad is running on TV stations in Nashville and Memphis.

Freedom To Marry has run over two dozen ads supporting marriage equality across the country. This is the first time a station has refused their business.

Kentucky and Michigan follow Ohio and Tennessee with SCOTUS Filings For Same-Sex Marriage Review

Following the petitions filed on Friday by Ohio and Tennessee, the plaintiffs in the Kentucky and Michigan same-sex marriage cases – which recently saw their respective state’s bans upheld by the 6th Circuit Court of Appeals – have filed requests with SCOTUS for review of that 6th Circuit anti-equality ruling.

SCOTUS is highly expected to take up at least one if not all cases now that there is disagreement among federal appellate courts on marriage equality.

Tennessee Plaintiffs File Request With SCOTUS Over Same-Sex Marriage Recognition

The plaintiffs in the current same-sex marriage recognition case in Tennessee have filed their petition for a writ of certiorari with the Supreme Court.

This makes Tennessee the second case to ask SCOTUS for review since the 6th Circuit Court of Appeals upheld same-sex marriage bans in Tennessee, Michigan, Ohio and Kentucky.

Earlier today, the plaintiffs from Ohio filed their similar request with SCOTUS.

Plaintiffs In 6th Circuit Court Marriage Ban Ruling Look To SCOTUS

According to Buzzfeed’s Chris Geidner, all sets of plaintiffs from yesterday’s 6th Circuit ruling upholding bans on same-sex marriage have conferenced and the decision is to unanimously head to the US Supreme Court.

Abby Rubenfeld, the lead lawyer for the Tennessee plaintiffs, updated BuzzFeed News about Friday’s call with the counsel from all four states.

“We just had a conference call with the attorneys from all four Sixth Circuit states on the marriage cases. We were all in agreement to apply for certiorari at the supreme court, and not to first seek en banc review in the Sixth Circuit,” she explained. “Given the significance of the issue, the reality that it will end up in the Supreme Court ultimately, and the harms that all of our clients are suffering each day that their marriages are not recognized, we want to get to the Supreme Court sooner rather than later.”

“We hope to file within two weeks, and hopefully sooner, so that we can still be on the docket for this term—which means resolution by june 30, 2015,” she added.
