State Of Alabama Tries To ‘Cheap Out’ On Paying Marriage Equality Lawyers

In most legal matters, the losing side of a litigated case often pays the fees of the winning side’s lawyers.

Now that same-sex marriage is the law of the land, the law offices who worked for years on behalf of couples seeking equal marriage rights are sending in the bill to those states who chose to draw out the litigation.

But in Alabama, Attorney General Luther Strange is trying to cheap out on paying the winning lawyers, saying they “didn’t reinvent the wheel.”

Alabama Attorney General Luther Strange said in an Oct. 21 filing in the U.S. District Court of Mobile that the nearly $200,000 in reimbursable costs claimed by the two attorneys is “excessive in light of the work performed and the results achieved.”

“The fee they claim is entirely excessive and should be cut dramatically,” the filing states.

Instead, Mobile attorneys Christine Hernandez and David Kennedy – who sought a $275 hourly rate – should be reimbursed about $50,000, according to the filing. The state’s figure factors in a $150 hourly fee that it claims is more “reasonable” for lesser experienced attorneys working in a smaller practice.

According to the filing, the lower hourly rate is justified because the two attorneys “did not have to reinvent the wheel.”

“The legal issues presented here may have been novel to this state, but they were not novel to the law, and Alabama’s marriage laws presented no unique issues that were not present in the marriage laws of other states,” the filing states.

Subsequently, Kennedy wrote a scathing response that puts the burden of some of the costs on Strange’s office.

“After causing the litigation to be lengthier, fiercer, and ultimately more costly than necessary, Strange now asserts that Plaintiff’s counsel spent too much time working on this case,” Kennedy wrote in an Oct. 28 filing. “In other words, the losing party is criticizing how much time it took undersigned counsel to redress the unconstitutional discrimination against the Plaintiffs.”

Hernandez and Kennedy represented lesbian couple Cari Searcy and Kim McKeand in their winding and politically fraught adoption battle.

“The State and Strange should not be rewarded by reducing the reasonable fees claimed by the Plaintiffs because the State of Alabama not only caused the litigation, but it also caused the amount of time, money and effort expended by the Plaintiff’s counsel.”

My opinion is this is anti-gay sour grapes on the part of Alabama and Attorney General Strange. Especially when you consider that Mobile County Probate Judge Don Davis’ office billed almost $345,000 back to Mobile County on the issue.

The issue will be decided by U.S. District Judge Ginny Granade.

Alabama: Walmart Sells Gun Oil Personal Lube In Gun Section

A shopper in the gun section of an Alabama Walmart, Jamie Lee Bracey, came across a product he hadn’t heard of before named “Gun Oil H2O.” Thinking the bottle was actually gun oil, he turned the bottle over and read the label.

Alabama Ku Klux Klan Member Claims Auschwitz Was A Jewish “Summer Camp”

An Alabama chapter of the Ku Klux Klan allowed a BBC news crew to follow their activities to explore and better understand racist attitudes in the U.S. following the murders of 9 church-goers by a white supremacist in Charleston.

As Klan members assemble 3,000 fliers to deliver to a predominately black neighborhood, the BBC interviewer notices a photograph of Adolf Hitler on the wall.

“Adolf Hitler, he was one of the smartest men there ever was,” a Klan member explains. “The so-called concentration camps like Auschwitz and so forth, they say they were death camps. But these death camps, they gave the so-called people that were being killed cigarettes, there was coffee, there was a movie theater, a library, even a swimming pool in Auschwitz.”

“And if you’re going to sit there and kill all these people then how come all these things would be in there?” he continues. “It’s more like a summer camp.”

“Sorry,” the stunned interviewer interrupts. “You’re telling me Auschwitz was like a summer camp?”

“Well, they had a swimming pool, a movie theater and everything else,” the Klan member insists. “You know, you don’t see in prisons today any kind of swimming pool being in the middle of the prison hall.”

“So what do you think the Jews were doing in Auschwitz?” the interviewer asks.

“Swimming,” the white supremacist replies. “And working. Because they didn’t want to do any work, and what Hitler was trying to do was he was trying to teach them to work, trying to rehabilitate them, if you will.”

“Where did you hear this?” the dumbfounded interviewer wonders.

“It’s all history,” the Klan member says.

Although the BBC interviewer continues to press, Klan members eventually tire of the subject and head out to distribute their fliers.

“In Britain, inciting racial hatred carries a possible sentence of seven years in prison,” the narrator explains to the British audience. “Here in the U.S., the First Amendment guarantees free speech. Even for blatant racism.”

“More than a million prisoners died at Auschwitz,” the narrator adds. “The vast majority of them were Jewish.”

Troubling News: Donald Trump Inspires Violence In Supporters

The New York Times interviewed supporters of GOP hopeful Donald Trump at his rally in Alabama last night.

Here’s what The Donald’s fans say they are hoping for:

“When he gets in there, he’ll figure it out,” said Amanda Mancini, who said she had traveled from California to see Mr. Trump. “So we do have to trust him, but he has something that we can trust in. We can look at the Trump brand, we can look at what he’s done, and we can say that’s how he’s done everything.”

Still, others said they had plenty of advice for the man they regularly identified in conversation as “Mr. Trump.”

“Hopefully, he’s going to sit there and say, ‘When I become elected president, what we’re going to do is we’re going to make the border a vacation spot, it’s going to cost you $25 for a permit, and then you get $50 for every confirmed kill,’ ” said Jim Sherota, 53, who works for a landscaping company. “That’d be one nice thing.”

In related violent thinking, earlier this week, two brothers from South Boston ambushed and beat a Hispanic homeless man.

After being arrested, one of the brothers said the attack was inspired in part by GOP presidential candidate Donald Trump. “Donald Trump was right, all these illegals need to be deported,” he allegedly told the police.

When Trump was informed of the statement, he said, “I will say that people who are following me are very passionate. They love this country and they want this country to be great again. They are passionate.”

THIS is who supports Donald Trump.

Alabama: 13 Counties Are Still Refusing To Issue Same-Sex Couples Marriage Licenses

Southern Equality reports that 13 counties in Alabama are still refusing to issue marriage licenses to same-sex couples.

Come on, kids. What’s it gonna take to get you to do your duty as an elected official? You can’t  pick and choose what parts of your job you will or will not do.

Across the 13 impacted counties, projected annual lost revenue totals $132,106.50 due to probate judges closing county offices.

A total of 330,236 people live in the 13 Alabama counties that are not issuing marriage licenses to any couples. Additionally, an estimated 313 same-sex couples live in the impacted counties, with an estimated 18% of them raising children.

Alabama Governor Orders Confederate Flag Removed From State Capitol

Alabama Gov. Robert Bentley (R) ordered the removal of the Confederate flag from the grounds of the state Capitol Wednesday morning, saying it was simply “the right thing to do.”

According to AL.com, two state workers “with no fanfare quickly and quietly took the flag down.”

In a statement, Gov. Bentley said his decision was based in part on the recent shooting in South Carolina.

“Yes, partially this is about that,” said Bentley. “This is the right thing to do. We are facing some major issues in this state regarding the budget and other matters that we need to deal with. This had the potential to become a major distraction as we go forward. I have taxes to raise, we have work to do. And it was my decision that the flag needed to come down.”

Alabama: Anti-Gay Group Rallies Against Marriage Equality For Possibly The Last Time?

Does this look like 1,000 people?

The anti-gay Sanctity of Marriage group organized what might be seen as a last ditch effort to demonstrate against same-sex marriage in advance of the impending ruling from SCOTUS.

Almost 1,000 people braved the heat and sun for the event, congregating under shade trees and umbrellas to escape the sun.

A large part of the crowd was there to support Christian values and traditional marriage, but many were there in opposition to show their support of same-sex marriage.

Signs that read, “1 Man+1 Woman= marriage” and “Marriage is a Sacred Covenant,” were seen right alongside those that read, “Love will win!” and “I don’t follow your religion and you can’t make me.”

U.S. Representative Gary Palmer appreciated the crowd’s civility, but pointed out one of the signs from the same-sex camp.

“I’ve seen these signs that read, ‘I don’t follow your religion and you can’t make me,'” Palmer said. “Well that’s not the point. You can’t make us not believe what we believe.”

It’s always so interesting that the haters opposing marriage equality frame the issue as LGBTs and our allies want to “make” them do anything.

No one who supports same-sex marriage really cares about the haters. Just let the gays live their lives with the same rights as you.

The real issue is the haters want to KEEP US from being equal.

Our goal has no effect on your lives; your goal denies us rights.

Alabama: House Committee Votes Down Attempt To Abolish Marriage Licenses For The Whole State

The Alabama legislature’s attempt to do some kind of “end run” around a possible nationwide marriage equality victory at SCOTUS has died in a House committee vote.

The legislation would attempt to do away with state-issued marriage licenses and be replaced by “contracts.”

The House Judiciary Committee on Wednesday voted down a bill that would abolish the requirement that couples obtain a marriage license from a probate judge before their wedding.

Instead, couples would have had to bring in a signed marriage contract witnessed by a minister, lawyer or other authorized person and file it with the probate office.

Republican Sen. Greg Albritton of Range said the intent of his bill was to avoid chaos over the issuance of the licenses.

Opposed committee members said they were hesitant to make such a major change to state marriage law.
