Poland Recognizes Same-Sex Marriages From EU Nations

Poland now recognizes same-sex marriages performed in European Nation countries per a ruling from the EU’s top court issued last November.

The regulations, signed earlier this year, introduce official documents covering three forms of marriage: between a woman and a man, two women, or two men. Civil registry offices can now use the forms to transcribe foreign same-sex marriage certificates.

The Court of Justice of the European Union and Poland’s Supreme Administrative Court rulings that prompted the change directly concerned same-sex marriages legally concluded in other EU member states,

However, the new documents do not specify where a marriage was concluded, leaving it unclear whether marriages concluded outside the EU will also be transcribed automatically.

The change follows recent rulings by the Court of Justice of the European Union and Poland’s Supreme Administrative Court requiring Polish authorities to recognise same-sex marriages legally concluded in other EU countries.

Warsaw became the first Polish city to transcribe a same-sex couple’s marriage certificate in May.

While same-sex marriages performed outside Poland are now recognized, same-sex marriage performed in Poland are still illegal.
