President Biden has issued a new executive order that effectively closes the U.S.-Mexico border when average illegal entries surpass 2,500 per day.

The restrictions kick in once the seven-day average for illegal entries hits 2,500 per day. Daily totals already exceed that number, which means that Mr. Biden’s executive order could go into effect right away — allowing border officers to return migrants across the border into Mexico or to their home countries within hours or days.
Typically, migrants who cross illegally and claim asylum are released into the United States to wait for court appearances, where they can plead their cases. But a huge backlog means those cases can take years to come up.
Donald Trump tried a similar approach when he was in the White House, and a federal court shut that down. Biden’s executive order does have a few exceptions, including for minors who cross the border alone and those who use a Customs and Border Protection app to schedule an appointment with a border officer to request asylum.
This new executive action includes much of what was in the bipartisan border bill that Republicans derailed in February. Donald Trump asked congressional GOPers not to approve the bill, which would then give Biden a legislative “win” during an election year. In general, presidents would rather see solutions to problems found through legislation because executive orders can be reversed with a signature by the next president. But since Republicans blocked the bipartisan bill earlier this year, this ends up Biden’s only solution for now.
