Supreme Court Declines To Review Ruling On Transgender Bathroom Rights

The U.S. Supreme Court has declined to review a ruling from a federal appeals court last year that held in favor of a transgender middle school student in Indiana to use the boys’ bathroom. Today’s decision leaves the lower court’s ruling in place, requiring the school to treat trans students equally. https://twitter.com/USATODAY/status/1747371156246556796 From USA Today:

Ruling in favor of the student last year, the Chicago-based U.S. Court of Appeals for the 7th Circuit said it assumed the Supreme Court will step in at some point.

Until then, the judges said, they are sticking with the standards they applied in a 2017 ruling that allowed a transgender high school student in Wisconsin to continue using the boys’ restroom.

Lawyers for the Indiana transgender student said the court shouldn’t take the case; the student is now in high school and able to use his preferred restroom.

The Supreme Court declined to review a similar case in 2021, after the U.S. Court of Appeals for the 4th Circuit ruled that bathroom restrictions at a Virginia school amounted to discrimination. All these kids want to do is go to the bathroom without incident, folks. Can we just let them use the bathroom? https://twitter.com/HRC/status/1747285267575165282
