Supreme Court Justice Ruth Bader Ginsberg Undergoes Heart Surgery

Supreme Court Justice Ruth Bader Ginsberg, a member of the high court since 1993, has undergone heart surgery earlier this morning:

Supreme Court Justice Ruth Bader Ginsburg, 81, underwent a heart procedure Wednesday morning to have a stent placed in her right coronary artery.

A blockage was discovered after Ginsburg “experienced discomfort during routine exercise” Tuesday night and was taken to the hospital, according to a release from the Supreme Court.

Ginsburg is resting “comfortably” at MedStar Washington Hospital Center and is expected to be released in the next 48 hours.

Ginsberg has previously been treated for colon cancer and pancreatic cancer. However, this summer she squashed talk of any near-term retirement.

“As long as I can do the job full steam…I think I’ll recognize when the time comes that I can’t any longer. But now I can,” she told Elle magazine.

Supreme Court Justice Ruth Bader Ginsburg: “No Crying Need To Step In” On Same-Sex Marriage

In an interview with NPR’s Nina Totenburg in New York City, Supreme Court Justice Ruth Bader Ginsburg said the court decided against review of seven appeals challenging the marriage bans in five states across the U.S. because all of the federal appeals courts that have so far ruled on the issue are in agreement that the bans are unconstitutional:

“When there’s no disagreement among the Courts of Appeals, we don’t step in.”

“The major job that the court has is to keep the law of the United States more or less uniform. So when the courts of appeals disagree about what the law of the United States is, then we are obligated to grant review.

“If there had been a Court of Appeals on the other side, we probably would have taken that case. But up to now, all the Courts of Appeals agree, so there is no crying need for us to step in.”

That being said, a ruling could come at any time from the 6th Circuit Court of Appeals. The oral arguments have led many to believe the 6th may uphold the same-sex marriage bans in Ohio, Michigan, Kentucky and Tennessee. That would lead to an appeal to SCOTUS, and at that time the court would most surely take the case for review.

Justice Ruth Bader Ginsberg Hints At SCOTUS Action On Marriage Equality Appeals

Speaking at the University of Minnesota on Tuesday, Justice Ruth Bader Ginsburg hinted on the Supreme Court’s plan of action on the issue of gay marriage, pointing to the 6th Circuit Court of Appeals cases.

The AP reports:

[Ginsburg] said ‘there will be some urgency’ if [the Sixth Circuit] allows same-sex marriage bans to stand.

Such a decision would run contrary to a legal trend favoring gay marriage and force the Supreme Court to step in sooner, she predicted.

She said if the appeals panel falls in line with other rulings there is ‘no need for us to rush.’

New York: Supreme Court Justice Ruth Bader Ginsberg to officiate second same-sex marriage

Supreme Court Justice Ruth Bader Ginsberg will officiate the wedding of her former law clerk, Danny Rubens, and his longtime partner Danny Grossman, this weekend in New York.

This will be the second same-sex marriage to be performed by the Supreme Court Justice.

 In August of 2013, Ginsberg officiated the wedding of Michael Kaiser, of the Kennedy Center for the Performing Arts to economist John Roberts.
