Same-Sex Spouses (Finally) Win Equal Access To Social Security Benefits

A federal judge ruled on Wednesday that the Social Security Administration (SSA) can’t deny survivor benefits to same-sex couples who were unable to be married for the required nine months due to gay marriage bans. Even though marriage equality became the law of the land in June of 2015, some same-sex couples still found a discriminatory barrier in their way when applying for spousal benefits. Lambda Legal brought a class action lawsuit, Ely v. Saul, which included the case of Michael Ely. Ely met James Taylor (not the famous musician) in 1971 in California. After 20 years together, the couple moved to Tucson, Arizona, where Taylor found work as a jet mechanic and Ely maintained their home. Although same-sex marriage wouldn’t arrive in Arizona for several more years, the two men had a commitment ceremony in 2007. And when the state’s marriage laws changed in late 2014, after being together for 43 years, Ely and Taylor exchanged marriage vows and became legally married. But six months later, Taylor would lose his battle with cancer. SSA denied Ely survivor’s benefits for not being married for nine months, even though that was legally impossible for him in Arizona. James Obergefell, the plaintiff in the landmark Supreme Court case Obergefell v. Hodges that ultimately made same-sex marriage legal everywhere in the U.S., was also a plaintiff in Ely v. Saul. Mr. Obergefell didn’t qualify for a lump-sum benefit from the SSA because when his husband, John Arthur, died they had only been legally married for three months due to Ohio’s marriage laws. Even though they were together 20 years, 9 months and 22 days, their three-month marriage wasn’t enough for the SSA.

But Judge Bruce G. Macdonald’s decision in the U.S. District Court of Arizona changed all that. Macdonald wrote in his ruling: “Because same-sex marriage is a fundamental right, and the underpinnings of the duration-of-marriage requirement has relied on the unconstitutional ban of that right, it cannot be said to be rationally related to a legitimate interest to a surviving spouse such as Mr. Ely.” Peter Renn, one of the Lambda Legal attorneys, told NBC News that even with the Obergefell decision five years ago, the plaintiffs in the case “have been deprived the protections of marriage” and without this court victory they would have been deprived those protections for the rest of their lives. “Being able to access survivors benefits can make the difference for whether someone can afford the basic necessities of life, like housing, food and health care,” Renn said. Because the court’s ruling also certified the case as a nationwide class action, same-sex spouses across the country who were similarly barred from meeting the 9-month requirement by discriminatory marriage bans will have a pathway forward to relief. One class member, Josh Driggs, from Phoenix, Arizona, already experienced homelessness on two separate occasions after Social Security denied him survivor’s benefits based on his more than 40-year relationship with his husband, Glenn Driggs, and he fell behind in his rent without the financial protection of those benefits. “While these monthly benefits may seem modest, they can make the life-changing difference between having enough food, medication, or a roof over one’s head,” Driggs said. Asked if he feels he might be inciting racial unrest by inviting his supporters to appear outside the White House tonight, Donald Trump told reporters today that ‘MAGA loves black people.’ “MAGA. Make America great again. These are people that love our country. I have no idea if they were going to be here, I was just asking. I have no idea if they were going to be there, MAGA is make America great again. By the way, they love African-American people, they love black people. MAGA loves black people. I heard that MAGA wanted to be there and a lot of MAGA was going to be there and I have no idea. They love our country.”

Wife Of Charged Minneapolis Officer Files For Divorce

Kellie Chauvin, the wife of fired Minneapolis police officer Derek Chauvin, has issued a statement through her attorney that she sends her condolences to the family of George Floyd and she has filed for divorce. “This evening, I spoke with Kellie Chauvin and her family. She is devastated by Mr. Floyd’s death and her utmost sympathy lies with his family, with his loved ones and with everyone who is grieving this tragedy. She has filed for dissolution of her marriage to Derek Chauvin,” the Sekula Law Offices said in a released statement. “While Ms. Chauvin has no children from her current marriage, she respectfully requests that her children, her elder parents, and her extended family be given safety and privacy during this difficult time,” the statement continued. The announcement spurs several questions. Is Ms. Chauvin leaving her husband because she has an opinion about his actions? Were there previous domestic issues at home? Many commenters on Twitter believe the divorce would be a way to protect the couple’s assets in case he were to be sued in a civil case, which I hadn’t thought of. Things that make you go ‘hmm…’

Chicago Mayor Sends Coded ‘F*** You’ To Trump

Chicago Mayor Lori Lightfoot on Friday called out Donald Trump for trying to “foment violence” and offered a coded response for tweets that appeared to threaten Minneapolis rioters protesting the death of George Floyd at the hands of police. From the Chicago Sun-Times:

“We see the game he’s playing because it’s so transparent and he’s not very good at it. He wants to show failures on the part of Democratic local leaders to throw red meat to his base. His goal is to polarize, to destabilize local government and inflame racist urges. And we can absolutely not let him prevail,” Lightfoot said.

“I will code what I really want to say to Donald Trump. It’s two words: It begins with F and ends with YOU.”

On Thursday night, President Trump took to Twitter as protesters surrounded a Minneapolis police station and set fire to it.

He characterized the protesters as “THUGS” and tweeted, “Just spoke to Governor Tim Walz and told him that the Military is with him all the way. Any difficulty and we will assume control but, when the looting starts, the shooting starts.”

On Friday, Lightfoot accused the president with whom she has clashed repeatedly of attempting to “foment violence.” She made no apologies for the vulgar reference that ran contrary to the advice of former First Lady Michelle Obama’s infamous line that, “When they go low, we go high.”

“I am not Michelle Obama,” the mayor said.

Louisville Police Fires Pepper Balls At Local News Crew

Louisville’s NBC News affiliate reports the station’s own reporter, Kaitlin Rust, and photojournalist James Dobson, were hit by pepper balls reportedly fired by an LMPD officer during a protest in downtown Louisville Friday night.

It was previously reported that the officer was firing rubber bullets, but Jessie Halladay with the Louisville Metro Police Department said LMPD officers do not use rubber bullets, and it was likely that was Rust and Dobson were hit with pepper balls.

In response to what happened to Rust and Dobson, WAVE 3 News General Manager Ken Selvaggi issued a statement saying, “We strongly condemn the actions of the LMPD officer who tonight repeatedly fired at and hit our reporter and cameraman, both of whom were courageously and lawfully covering breaking news in their community. There is simply no justification for the Louisville police to wantonly open fire, even with pepper balls, on any journalists under any circumstances.”

During night two of several hundred protesters gathering downtown, crowds appear to be larger and police are continuing their efforts to clear the area.

• The Hill: Donald Trump announced Friday that the United States is “terminating” its relationship with the World Health Organization (WHO) over its response to the novel coronavirus, following through on a threat issued earlier this month. Trump accused the WHO of being under China’s “total control” and of failing to make reforms requested by his administration. The president said he would “redirect” funds promised to the WHO to assist other global health needs. • TechCrunch: SpaceX had just conducted yet another static fire test of the Raptor engine in its Starship SN4 prototype launch vehicle on Friday when the test vehicle exploded on the test stand in Boca Chica, Texas. This was the fourth static fire test of this engine on this prototype, so it’s unclear what went wrong vs. other static fire attempts.

Vandals Burn ‘FAG’ Into The Front Lawn Of Ohio Gay Couple

Bradley O’Dell and his fiancé Mike Stone were recently stunned to see someone had used chemicals to burn a homophobic slur into their front lawn. The couple told local news station WHIO that they’ve lived in their home in Arcanum, Darke County, for about a year. “I grew up in this town,” said O’Dell. “I moved back for a reason and that’s because I know this community as a whole is great.” But on May 22nd, Stone says he walked outside to find someone had burned the homophobic slur ‘F*G’ into the grass in their front yard. “I never in a million years thought I would see that in my front yard,” Stone said. “I’m angry, I don’t understand. But, as a gay man, I feel like I’ve gone through this before. It’s almost like it comes with the territory.”

“Am I pissed? Livid like you’ve probably never seen me,” wrote Stone in a Facebook post. “Did I go right ahead and mow that sh*t down and go about my day? After filing a police report and finding out many of our neighbors have security cameras that cover our block, you flippin bet I did.” Adding that the couple refuses to let an act of “small-minded ignorance” be allowed to bring negativity into their lives, they created a fundraiser on Facebook for the local organization Have a Gay Day. The organization works to create a safe environment for the purpose of equality, education, and support for the LGBTQ community and its allies. In six days, the fundraiser has racked up nearly $5,000 in donations. “The love and support that has been shown and spread from our story has been incredible,” wrote Stone thanking friends, family, and strangers for their contributions. “Whether you are near or far, thank you for all of the love and compassion you have shown us and each other.” “If this hateful act had to happen, we are thrilled to be able to turn it into a message of love and support,” he added. Arcanum Police Chief Marcus Ballinger told WHIO that the investigation into who is responsible for the vandalism is still underway, but he’s not sure what the culprit would be charged with. “It all comes down to what the prosecutors’ office decides how they want to proceed,” said Ballinger. “Right now we’re in the investigative phase of the case.” Ohio has no statewide hate crime statute regarding crimes against someone for sexual orientation.  

Same-Sex Weddings Have Added $3.8 Billion To Economy Since 2015

Same-sex married couples can now access full Social Security benefits after the Biden administration withdrew Trump administration appeals against same-sex couples

During the years leading up to same-sex marriage being legalized nationwide in 2015, LGBTQ activists often extolled the financial upside marriage equality would bring to the economy. According to researchers at the Williams Institute at the UCLA School of Law, those predictions of economic boost turned out to be accurate. Since the ground-breaking 2015 ruling by the U.S. Supreme Court in Obergefell v. Hodges, almost 300,000 gay and lesbian couples have exchanged wedding vows. The study’s lead author, Christy Mallory, told Reuters that, in addition to changing the lives of same-sex couples and their families, marriage equality has “has also provided a sizable benefit to business and state and local governments.” Using figures and estimates based on data from the U.S. Census Bureau, the researchers found $3.2 billion has been spent on same-sex weddings in the U.S.  Additionally, wedding guests who traveled to take part in the nuptials doled out $544 million in travel expenses. And state and local governments took in an additional $244 million in taxes related to the events. The data also shows same-sex weddings have helped to support nearly 45,000 jobs. Beginning with Massachusetts in 2003, marriage equality slowly became legal state-by-state. From 2003 to 2015, it’s estimated that 242,000 same-sex weddings were held in the U.S.  Today, more than half a million lesbian and gay couples have tied the knot.

Fired Police Officer Who Knelt On George Floyd’s Neck Arrested

The Minneapolis police officer shown on video putting his knee on the neck of George Floyd has been arrested, according to Minnesota Public Safety Commissioner John Harrington.

Derek Chauvin, who was fired on Monday along with three other officers involved in the detainment of Floyd, was taken into custody Friday.

Video showed Chauvin kneeling on Floyd’s neck for at least eight minutes on Monday night. The police department initially said Floyd “physically resisted” the officers and that he died after “suffering medical distress.”

The Minnesota Bureau of Criminal Apprehension and the FBI are both investigating Floyd’s death.

Chauvin has been charged with third-degree murder and manslaughter in the death of George Floyd, Hennepin County Attorney Mike Freeman announced Friday afternoon. In related news, the local ABC News affiliate KSTP reports Chauvin and Floyd both worked as security guards at the El Nuevo Rodeo club on Lake Street, according to Maya Santamaria. Santamaria owned the building for nearly two decades, but sold the venue within the last few months. “Chauvin was our off-duty police for almost the entirety of the 17 years that we were open,” Santamaria said. “They were working together at the same time, it’s just that Chauvin worked outside and the security guards were inside.” So, it’s difficult to imagine the two men didn’t know each other. And then to find themselves in this odd situation? Something doesn’t add up here…
