Republican lawmakers in South Carolina are jumping on the “overturn same-sex marriage” bandwagon with their own resolution calling on the U.S. Supreme Court to reverse its 2015 Obergefell ruling that legalized marriage equality nationwide.
House Concurrent Resolution 5501 declares that marriage “is a union of one man and one woman,” and same-sex marriage conflicts with “Anglo-American legal tradition.”

The resolution argues that the ruling conflicts with the Constitution and undermines both states’ rights and religious liberty.
It cites South Carolina’s 2006 voter-approved amendment defining marriage as between a man and a woman, which passed with nearly 78% support.
The 2015 Supreme Court decision, Obergefell v. Hodges established a nationwide right for same-sex couples to marry, invalidating state bans.
It remains the law of the land, reinforced by the federal Respect for Marriage Act, which ensures legal recognition of same-sex marriages across states.
Supporters of the resolution say it reflects South Carolina voters’ values and reaffirms state authority over marriage policy.
However, concurrent resolutions carry no legal force and do not alter federal law.

Republican State Rep. Stephen Frank is the primary sponsor of the resolution. In 2023, he sponsored legislation that would have imposed the death penalty on women who have abortions.
He’s also mocked Canada as a gay country, called for firing folks who criticized the late Charlie Kirk, and is virulently anti-vaccines.
