Lindsey Graham: ‘States Should Decide The Issue Of Marriage’

Sen. Lindsey Graham (R-SC) says same-sex marriage recognition should be left to states to decide not the federal government

During an appearance on CNN’s State of the Union today, Sen. Lindsey Graham (R-SC) said he believes the issue of recognizing same-sex marriage should be left to the states – NOT the federal government.

Folks have been concerned about same-sex marriage rights ever since Justice Clarence Thomas made a point in his concurring opinion to reverse Roe v. Wade to say the Supreme Court should reconsider previous rulings that protect same-sex relationships, access to contraceptives, and marriage equality.

Since Thomas’s ruling, Democratic lawmakers have moved to pass legislation which would codify marriage equality into national law. The bill has passed the House and currently sits in the Senate.

From Axios:

Graham said he believes the Supreme Court’s 2015 decision to legalize same-sex marriage would not be overturned, but that doing so “would be up to the court.”

“I think states should decide the issue of marriage and states should decide the issue of abortion,” Graham said.

“I have respect for South Carolina. South Carolina voters here I trust to define marriage and to deal with the issue of abortion. Not nine people on the court. That’s my view.”

“We’re talking about things that don’t happen because you don’t want to talk about inflation, you don’t want to talk about crime,” Graham added, referencing Democrats.

“We’re talking about constitutional decisions that are still in effect. But if you’re going to ask me to have the federal government take over defining marriage, I’m going to say no.”

It’s notable that when asked directly about the high court’s ruling Loving v. Virginia, which made interracial marriage legal, LindseyGraham said THAT marriage law should NOT be regulated by the states.

So, when he says “states should decide the issue of marriage,” he only means same-sex marriage – not any other categories of marriage.
